Dismissal of Mkhwebane: Dali Mpofu can request the recusal of the president of the investigation under article 194

Lawyer Dali Mpofu, acting on behalf of suspended public protector Busisiwe Mkhwebane, told parliament he could seek the disqualification of the chairman of the Article 194 committee, Qubudile Dyantyi.

This comes after Mkhwebane’s latest request for annulment was rejected by the Constitutional Court (ConCourt) on Wednesday, with the top court ruling that “no case has been prepared for annulment.”

The ConCourt ordered Mkhwebane to pay the costs of the claim personally, after finding that his legal offer constituted an abuse of legal process.

The Québec Ombudsman had filed a second request for annulment with the aim of annulling the ConCourt’s decision of May 6, which paved the way for the dismissal procedure against him.
